By accessing and using the Professional Project Management License (PML) website and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms apply to all users of the Service, including visitors, registered users, and those who have purchased access to our courses and certification exams.

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Immediately notify us of any unauthorized use of your account

3.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.

4.1 Pricing

All prices are listed in USD and are subject to change. We reserve the right to modify our pricing at any time. Changes to pricing will not affect purchases already made.

4.2 Payment Processing

All payments are processed securely through Stripe. By making a purchase, you agree to provide current, complete, and accurate payment information. You authorize us to charge your chosen payment method for all fees incurred.

4.3 Refund Policy

We offer a 30-day money-back guarantee for all purchases, subject to the following conditions:

• Refund requests must be made within 30 days of purchase
• For exam-inclusive tiers, refunds are not available once the exam has been taken
• Course-only purchases can be refunded within 30 days regardless of usage
• Refunds are processed to the original payment method within 5-7 business days

4.4 No Automatic Renewal

All purchases are one-time payments. We do not automatically renew subscriptions or charge recurring fees unless explicitly stated at the time of purchase.

5.1 License Grant

Upon purchase, we grant you a limited, non-exclusive, non-transferable license to access and use the course materials for your personal, non-commercial use only.

5.2 Prohibited Uses

You agree not to:

• Share your account credentials with others
• Reproduce, distribute, or create derivative works from course materials
• Record, screenshot, or copy course content for distribution
• Use course materials for commercial purposes
• Resell, sublicense, or transfer your access to others
• Attempt to reverse engineer or extract source code from the platform

5.3 Access Duration

Access to course materials is granted for the duration specified in your pricing tier:

• Course Only: 6 months from purchase date
• Course + Certification: 1 year from purchase date
• Premium Package: Lifetime access

6.1 Exam Honor Code

By taking the PML certification exam, you agree to adhere to our Exam Honor Code, which includes:

• Not using external resources during the exam (search engines, notes, books, etc.)
• Not copying, screenshotting, or sharing exam questions
• Not collaborating with others during the exam
• Not switching browser tabs or windows during the exam
• Completing the exam in one sitting without unauthorized interruption

6.2 Exam Attempts

The number of exam attempts included with your purchase varies by tier:

• Course + Certification: 3 attempts
• Premium Package: Unlimited attempts

Once you pass the exam and receive certification, you may not retake the exam.

6.3 Exam Violations

Violation of the Exam Honor Code may result in:

• Immediate exam invalidation
• Loss of exam attempts
• Revocation of certification (if already issued)
• Account suspension or termination
• No refund of purchase price

6.4 Passing Requirements

To pass the PML certification exam and receive your certificate, you must achieve a score of 70% or higher. Passing scores are final and not subject to appeal or review.

7.1 Certificate Issuance

Upon successfully passing the exam, you will receive a digital certificate in PDF format. The certificate is valid for 3 years from the date of issuance.

7.2 Certificate Validity

PML certificates are valid for 3 years. To maintain your certification beyond this period, you must complete the recertification process, which includes continuing education and a shorter recertification exam.

7.3 Certificate Revocation

We reserve the right to revoke your certification if:

• You violated the Exam Honor Code
• Your certification was obtained fraudulently
• You engage in conduct that damages the reputation of PML
• You use your certification for illegal or unethical purposes

7.4 Use of Credential

You may use the "PML" credential after your name in professional contexts (e.g., "John Doe, PML"). You agree to use the credential accurately and not misrepresent your certification status, level, or validity period.

All content on the Service, including but not limited to text, graphics, logos, images, videos, audio, software, and course materials, is the property of PML or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service without prior written consent, except as permitted for your personal, non-commercial use of the course materials you have purchased.

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.

10.1 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 No Guarantee of Results

While we strive to provide high-quality educational content, we do not guarantee that you will pass the certification exam, obtain employment, or achieve any specific outcome from using our Service.

10.3 Third-Party Recognition

We make no representations or warranties regarding how third parties (including employers, professional organizations, or educational institutions) will recognize or value the PML certification. Recognition may vary by industry, location, and organization.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PML, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless PML and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Your violation of the Exam Honor Code

13.1 Service Changes

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

13.2 Terms Changes

We may revise these Terms from time to time. The most current version will always be posted on our website with the "Last Updated" date. By continuing to use the Service after revisions become effective, you agree to be bound by the revised Terms.

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any disputes arising out of or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached within 30 days, the dispute may be submitted to binding arbitration.

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or policies published by us on the Service, constitute the entire agreement between you and PML concerning the Service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without your consent.
